Past Due Child Support or Maintenance Interest

The process of calculating the interest owed for either past due Court Ordered payments for Maintenance or Child Support includes a few factors that are often overlooked or simply not applied by the courts in part because the Judges and most of the attorneys simply are not educated enough on the issue.  As an example does the State Disbursement Unit payment history records include withheld payments by the State from unemployment? If you  are not sure then you need to make sure your attorney knows the answer. If the answer is no then where do you obtain the unemployment withholding records because the unemployment withholdings are a factor that must be included when determining the arrearage.  Failure to include interest in the arrearage is a good way to bar the accrual of interest in the future. The State forbids the compounding of interest on past due support.
